Bill Summary

This bill requires health benefit plans to ensure adequate coverage for a broad range of pain management services, including nonopioid medications and nonpharmacologic treatments. Health plans must cover at least two FDA-approved alternative prescription pain medications and at least three nonpharmacologic treatment options. The act prohibits health plans from imposing more restrictive utilization controls (such as prior authorization or step therapy) on clinically appropriate nonopioid drugs compared to opioid medications. It also mandates that the Division of Medicaid, when creating a preferred drug list, must ensure that nonopioid drugs are not unfairly disadvantaged compared to opioids.
